Declaration of the Czech Association of Circular Economy, z.s. (hereinafter also referred to as "CAOBH") on the protection of personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter also referred to as "GDPR")

The ČAOBH hereby informs that the processing of personal data and the purposes for which they are processed are fully in accordance with current European and Czech legislation.

All personal data entrusted to us is processed in a confidential manner.

A. Personal Data Processing Policy

Personal data is any information relating to an identified or identifiable natural person. Such information includes, in particular, name, surname, age, address, ID number, telephone number, date of birth, vehicle registration number, email address, IP address or user behaviour on websites, etc. Information that cannot or can only be transferred to a natural person with unreasonable effort, e.g. anonymous information, is not considered personal data. The processing of personal data, e.g. the collection, retrieval, use, storage and transmission of data, always requires a lawful reason or the consent of the natural person.

The personal data processed are deleted as soon as the purpose of processing is fulfilled and no legal reasons require the retention of these personal data.

B. Scope and purpose of the processing of personal data on the website

Personal data of website users is used only to the extent necessary for the functionality of the website and the content of the services. When you use the website, we only collect personal data that your browser automatically transfers to our server or data that you have provided to us yourself (e.g. via a contact form or by expressing interest in working for us).

Most often we may collect the following information, which you provide to us via contact forms: first name, last name, email, phone number, city, county, company.

We collect this personal data in order to provide you with the requested information and to respond to your questions or suggestions. The following information is recorded without your intervention and stored until it is automatically deleted:

  • The IP address of your computer;
  • date and time of access;
  • name and URL of the loaded file;
  • the network from which you are accessing (URL link);
  • browser and, if applicable, the operating system of your computer, as well as the name of your access provider.

The above data will be processed by the ČAOBH for the following purposes:

  • general administration;
  • analysis of the traffic of the CAOBH;
  • ensuring a smooth connection to and use of the CAOBH website.

We may also process your personal data without your consent in accordance with applicable law in the following cases:

  • processing that is necessary for the performance of the contract or for the conduct leading to the conclusion of the contract (pre-contractual relations) - order confirmation, payment processing and delivery of goods/services; our communication regarding the status of the order/completion of services; complaints procedure in the event of a claim for defects;
  • processing that is necessary for compliance with legal (statutory) obligations arising for us from generally binding legal regulations (e.g. the Accounting Act, waste management regulations);
  • processing is necessary for the purposes of our legitimate interestswhich is:
    • our interest in informing you about our services and providing you with targeted and relevant information;
    • our interest in ensuring that we communicate with each other - i.e. that we can answer your questions or request if you contact us;
    • our interest in improving the quality of our services and activities;
    • our interest in promoting our events and activities;
    • our interest in protecting and enforcing our rights - i.e. to prevent fraudulent practices, to prevent and avoid breaches of our terms and conditions, for the purposes of enforcing any claims and to ensure that our legal rights are protected);
    • our interest in protecting the property and health of persons - i.e. the operation of CCTV systems (as per D. below).

Personal data is deleted or blocked once the purpose for which it was provided has been fulfilled.

We do not disclose your personal data to third parties with the exceptions listed below:

  • the natural person has given explicit consent in accordance with Article 6(1) sentence 1 letter a) GDPR;
  • the provision of personal data is legally permissible and necessary for the performance of the contractual relationship with the data subject on the basis of Article 6(1)(b) GDPR;
  • there is a legal obligation to transfer data in accordance with Article 6(1)(c) of the GDPR;
  • the transfer of the personal data is in accordance with Article 6(1)(f) GDPR, is strictly necessary for the establishment or defence of legal claims and there is no reason to believe that there is an overriding interest worthy of protection which does not allow the transfer of the personal data.

CAOBH does not collect any personal data through social plugins.

C. Hyperlinks

The CAOBH website may use hyperlinks and may contain links to the websites of partners and affiliates, which in turn may contain links to the CAOBH website. If you use a link from any of our websites, please note that the linked websites have their own privacy policies and the CAOBH accepts no responsibility for those policies. Please check their privacy policies before submitting personal information to these websites.

D. Camera system

In accordance with the provisions of the GDPR, ČAOBH places camera systems in its premises in order to protect the property, safety and health of its employees and third parties. The monitored areas are visibly marked with a pictogram and a short accompanying text.

Video recordings of the camera system (audio recordings are not made) are kept for the period until the recording is overwritten by a new recording, which is in the order of several weeks, i.e. only the time necessary to detect a possible violation or damage event. The date and time is also displayed on the record.

The operation manager is authorised to control the camera system and access the recordings. In the event of an unlawful act or illegal condition, the footage will only be submitted to law enforcement authorities or another authorised body in accordance with the law, for example in the context of reporting an insurance claim to an insurance company.

Electronic records are made of access to CCTV footage to identify and verify when, by whom and for what reason personal data was recorded or otherwise processed.

If your personal data is processed, you are considered a data subject under the GDPR and the following rights apply to you

  • according to Art. 15 of the GDPR, you are entitled to obtain confirmation as to whether or not personal data concerning you are being processed; in particular, you may obtain information on the purpose of the processing, the category of personal data concerned, the recipient or category of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations, the intended period for which the personal data will be stored, or if this cannot be determined, the criteria used to determine that period, the existence of a right to request rectification or erasure of personal data relating to the data subject or restriction of processing and/or to object to such processing, the right to lodge a complaint with a supervisory authority, any information on the source of the personal data, unless obtained from the data subject, and the existence of automated decision-making, including profiling, and, where applicable, meaningful information concerning the procedure used.
  • according to Article 16 GDPR, it is possible to request the correction of inaccurate personal data without undue delay or the completion of incomplete personal data, including by providing an additional declaration.
  • According to Article 17 of the GDPR, you can request the deletion of the personal data you have provided to us provided that the processing is not necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims.
  • according to Article 18 of the GDPR, you can request a restriction of the processing of your personal data if you contest the accuracy of the data, the processing of the data is unlawful, if the data are no longer needed by the CCAOBH and the data subject refuses to delete the personal data on the grounds that it is necessary to preserve them for the establishment, exercise or defence of legal claims; you are also entitled to claim under Article 18 of the GDPR if you have objected to the processing in accordance with Article 21 of the GDPR.
  • According to Article 20 of the GDPR, you have the right to obtain the personal data you have provided to the ČAOBH in a structured, commonly used and machine-readable format or you can request that it be transferred to another controller.
  • According to Article 7(3) GDPR, you can withdraw your consent to the processing of personal data at any time; as a result, we are no longer permitted to process personal data on the basis of this consent in the future.
  • Under Article 77 of the GDPR, you have the right to lodge a complaint with a supervisory authority; you can contact the supervisory authority of your place of residence, workplace or place where the alleged infringement occurred.

If the processing of your personal data is carried out pursuant to Article 6(1)(e) or (f) of the GDPR, you have the right, as already mentioned, to object to the processing of your personal data pursuant to Article 21 of the GDPR, provided that there are grounds arising from your particular situation. E. Commitment of the ČAOBH to the protection of personal data

CAOBH is committed to protecting the privacy of individuals and treating personal data confidentially in accordance with the GDPR. To prevent the manipulation, loss or misuse of personal data, the CAOBH implements extensive technical and organizational measures, which are continuously monitored and adapted to the latest technical
